Terms of Service

1. Acceptance of Terms

By creating an account or using EduAI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. If you are using the Service on behalf of an educational institution, you represent that you have the authority to bind that institution to these terms.

2. Description of Service

EduAI is an educational technology platform that enables teachers and school administrators to create lesson plans, assessments, rubrics, presentations, and manage student data. The Service is designed exclusively for educational purposes.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Student Data and FERPA

The Service processes student education records as defined by the Family Educational Rights and Privacy Act (FERPA). By using the Service, you acknowledge and agree to the following:

You are authorized by your educational institution to access and manage student education records. You will only enter student data for legitimate educational purposes. You will not share student data with unauthorized individuals. You will comply with all applicable FERPA requirements. You are responsible for ensuring your institution has obtained any necessary consent from parents/guardians.

EduAI acts as a “school official” under FERPA, performing institutional services on behalf of the educational institution. We maintain direct control over student education records and comply with FERPA’s data protection requirements.

5. Children’s Data (COPPA)

If you use the Service with students under the age of 13, you represent that your educational institution has obtained the necessary parental consent or is acting under the FERPA school official exception. You agree not to collect unnecessary personal information from children under 13 through the Service.

6. Acceptable Use

You agree not to use the Service to:

Store or transmit data unrelated to educational purposes; share login credentials with unauthorized individuals; attempt to access student records belonging to other users; use the platform for commercial, advertising, or marketing purposes; violate any applicable law, regulation, or privacy requirement; or upload malicious content or attempt to compromise the security of the Service.

7. Data Security

We implement industry-standard security measures to protect student data, including encryption in transit and at rest, access controls, audit logging, and regular security reviews. However, no system is completely secure, and you acknowledge this inherent risk.

8. Data Ownership

You retain ownership of all content and data you create or upload to the Service. We do not claim ownership of student education records. Upon account termination, you may export your data before deletion.

9. Termination

You may terminate your account at any time through the data privacy settings. Upon termination, we will provide a 30-day grace period during which you can export your data. After the grace period, your data will be permanently deleted in accordance with our data retention policy.

10. Limitation of Liability

To the maximum extent permitted by law, EduAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email and in-app notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated terms.
